Important: These Terms include provisions concerning warranty disclaimers, limitations of liability, governing law, and dispute resolution. Nothing in these Terms limits rights that cannot be excluded under applicable consumer law.

1. Eligibility and Accounts

You must be at least the age of majority in your state, province, or country of residence to use the Services or place an order. If you allow a minor to use the Services through a device or account you control, you are responsible for that use to the extent permitted by law.

You agree to provide accurate, current, and complete account, billing, payment, and shipping information. You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.

You may not sell, transfer, assign, or license your customer account to another person.

2. Use of the Services

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for lawful personal or household purposes and in accordance with these Terms.

You may not use the Services in a way that violates applicable law, infringes another person’s rights, interferes with the operation or security of the Services, or enables unauthorized commercial exploitation of our content.

3. Product Information

We make reasonable efforts to display product descriptions, specifications, images, colors, prices, and availability accurately. Screen settings, production updates, and normal manufacturing variation may affect how a product appears.

We may update product information, discontinue a product, or limit quantities by customer, order, location, or jurisdiction. Product changes do not affect rights that have already arisen under an accepted order or applicable law.

4. Orders

Placing an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily mean that we have accepted the order. An order is accepted when we confirm acceptance or ship the product, subject to applicable law.

We may reject or cancel an order for legitimate reasons, including suspected fraud, payment authorization failure, pricing or inventory errors, shipping restrictions, or misuse of a promotion. If we cancel a paid order before shipment, we will refund the amount paid for the cancelled item.

Review your order before submitting it. After acceptance or fulfillment has begun, cancellation may not be possible. Eligible post-delivery returns are governed by our Refund Policy.

5. Prices and Payment

The price charged is the price displayed when the order is submitted, subject to correction of an obvious error as permitted by law. Unless stated otherwise, prices exclude shipping, handling, taxes, duties, customs fees, and similar charges. Applicable charges will be displayed during checkout when available.

Promotions may be subject to additional terms. If promotion-specific terms conflict with these Terms, the promotion-specific terms control for that promotion.

You represent that you are authorized to use the selected payment method and authorize us and our payment providers to charge all amounts shown at checkout.

6. Shipping and Delivery

Shipping destinations, charges, processing times, and estimated delivery times are described in our Shipping Policy and at checkout. Delivery estimates are not guarantees, but we will comply with shipping commitments and notification obligations required by applicable law.

If we cannot ship within the time stated, or within the period required by applicable law when no time is stated, we will provide notice and, when required, offer the choice to consent to a delay or cancel the unshipped order for a prompt refund.

Risk of loss remains with SKYFIRE until delivery to the address provided at checkout, except to the extent a different rule is required or permitted by applicable law. You are responsible for providing a complete and accurate delivery address and for following carrier instructions after a delivery attempt.

7. Returns, Refunds, and Warranty

Eligible unopened returns and refunds are governed by our Refund Policy. That policy includes the return window, eligibility requirements, customer-paid return shipping terms, and refund-processing timeline.

Product defects, replacement, repair, and warranty support are governed by our One-Year Limited Warranty. Return rights and warranty rights are separate. Nothing in these Terms limits rights that cannot be waived under applicable consumer law.

8. Intellectual Property

The Services and their text, graphics, product images, videos, audio, logos, trademarks, software, design, and arrangement are owned by or licensed to SKYFIRE and are protected by applicable intellectual-property laws.

Except as expressly permitted by law or in writing by us, you may not copy, modify, distribute, publish, display, transmit, create derivative works from, or commercially exploit material from the Services. No implied license is granted.

9. Third-Party Services and Links

The Services may include third-party payment, shipping, analytics, support, social-media, or other tools and links. Those services may be governed by the third party’s own terms and privacy policies.

We are not responsible for third-party websites or services that we do not control. Review the applicable third-party terms before using them or completing a transaction. This provision does not limit liability that cannot be excluded by law.

10. Relationship With Shopify

SKYFIRE Flashlight Store is powered by Shopify, which enables us to provide the Services to you. However, sales and purchases made through our store are made directly with SKYFIRE Flashlight Store.

By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and SKYFIRE Flashlight Store, including injury, damage, or loss resulting from purchased products and services. To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with SKYFIRE Flashlight Store.

11. Privacy

Our collection and use of personal information are described in our Privacy Policy. Because Shopify hosts the store, Shopify also processes certain information as described in Shopify’s privacy information for users.

By using the Services, you acknowledge that personal information may be processed by SKYFIRE, Shopify, and service providers in countries other than your own, subject to applicable privacy law and the privacy notices above.

12. Feedback and Reviews

If you voluntarily submit feedback, suggestions, photos, videos, or reviews, you grant SKYFIRE a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content for operating, improving, and promoting the Services, subject to applicable privacy and consumer-review laws.

You represent that you have the rights needed to submit the content and that it is accurate, lawful, and does not violate another person’s intellectual property, privacy, publicity, or other rights. Disclose any material incentive or compensation connected with a review.

We may moderate content for legitimate reasons, including illegality, abuse, fraud, malware, personal information, or violation of these Terms. We will not condition a consumer’s ability to provide an honest review on the review being positive.

13. Errors, Inaccuracies, and Availability

Information may occasionally contain typographical errors, pricing errors, omissions, or outdated availability. We may correct information and update the Services. If an error affects an order, we will contact you and provide any cancellation or refund rights required by applicable law.

14. Prohibited Uses

You may not use the Services to:

• Violate law or another person’s rights
• Commit fraud, impersonate another person, or submit false information
• Upload malware or interfere with security or operation of the Services
• Harvest personal information, spam, phish, scrape, or crawl except as permitted by law and our technical controls
• Harass, threaten, defame, or unlawfully discriminate against another person
• Circumvent purchase limits, access controls, or anti-fraud systems
• Resell or commercially exploit the Services or their content without authorization

15. Suspension and Termination

We may suspend or terminate access when we reasonably believe that you have materially violated these Terms, created a security or fraud risk, or used the Services unlawfully. Where appropriate and legally required, we will provide notice.

Termination does not affect rights and obligations that arose before termination. Provisions that by their nature should survive—including intellectual property, disclaimers, liability, indemnification, governing law, and payment obligations—remain effective.

16. Disclaimers

Except for the express commitments in an accepted order, our One-Year Limited Warranty, and rights that cannot be excluded under applicable law, the Services are provided on an “as is” and “as available” basis. We do not promise that the website will always be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, we disclaim implied warranties relating to the Services. We do not disclaim or limit implied warranties for consumer products where doing so is prohibited, including where a written warranty prevents such a disclaimer. Any permissible limitation is subject to the Limited Warranty and applicable law.

Nothing in these Terms excludes responsibility for product defects, personal injury, fraud, willful misconduct, or other liability that cannot lawfully be excluded.

17. Limitation of Liability

To the fullest extent permitted by law, SKYFIRE and its directors, officers, employees, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages, or for lost profits, revenue, savings, or data, arising from use of the Services.

These limitations do not apply to liability that cannot be excluded or limited under applicable law, including certain consumer-protection rights, product-liability claims, personal injury, fraud, gross negligence, or willful misconduct. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless SKYFIRE and its affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims and reasonable costs arising from your unlawful use of the Services, your material breach of these Terms, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from SKYFIRE’s own unlawful conduct.

19. General Terms

If a provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver.

These Terms and the policies incorporated by reference form the agreement between you and SKYFIRE concerning the Services. If a specific policy or promotion term conflicts with these Terms, the more specific term controls for its subject matter.

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, reorganization, sale of assets, or transfer of the Services, subject to applicable law.

20. Governing Law and Disputes

These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law principles. Subject to the paragraph below, the courts of Hong Kong have exclusive jurisdiction over disputes arising from these Terms or the Services.

If you are a consumer, this choice of law and forum does not deprive you of mandatory protections or dispute rights that cannot be waived under the laws applicable where you reside. Nothing in this section prevents either party from seeking urgent injunctive relief in a court with jurisdiction.

21. Changes to These Terms

We may update these Terms by posting a revised version on this page and changing the “Last updated” date. When required by law, we will provide additional notice of material changes. Changes apply prospectively from their stated effective date and do not reduce rights that arose before that date.
